One of the ways is through grandparent custody. Each state has unique term of guardianship. Therefore, the legal statement of grandparent custody differ from state to state. Despite the variation, they have to go through formal process as provided by the state before assuming the parental responsibilities of the child.
Firstly, physical permission with the power of a judge. When they stay with their grandchildren and they are responsible for the physical well being on a daily basis, they have a physical guardianship. This scenario often takes place when a guardian or a parent request the grandparent to look after the child temporarily. This kind of arrangement is done informally. They should be given a power of attorney called POA. This power grants them the legal permission to address emergency needs of the kid when the parent cannot be reached.
Secondly, they may be given a chance to serve as foster parents. This can happen if the state decides to remove children from the care of their parents. This kind of arrangements can also be called kinship. In this case, they have a physical custody, the state retains legal rights of the children. These are rights of making critical decisions concerning the child welfare.
As they exercise the parental duties, they are not under the supervision of the state neither do they depend on any assistance from the state. This type of relationship can also be referred to as informal kinship care. Some states require that they go through training and get certification to be called foster parents. Besides, they are paid stipend just like other foster parents.
When they want to have more control over their grandchildren, the court allows them to request for a legal guardianship. However, the parents can also retain the legal guardianship through petition in the court. When the grandparents are granted all the authority over the kid, the parents will still have the right to visit.
Guardianship is a term which is used differently in various states. It can be used to describe legal guardianship. A guardian often have more rights. For instance, they can give the kid to another person when they are not in a position to provide parental care. A child under guardianship is still entitled to visitation by the parent.
Adoption is also another way which can be used to acquire a child. Under adoption, the grand parent owns the infant permanently. Agreements leading to adoption are normally made between the children and the grandparents. Once the kid is adopted, the parents stop paying for foster care. Also, all the parental rights which the parent have over the kid ends. The person adopting will have to pay tax on credit adoption or subsidy on tax or both. They can still enjoy medical services provided by the state.
